TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your use of the FocusHer mobile application ("App") operated by Eren Yilmaz ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. ACCEPTANCE OF TERMS

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the App.

2. DESCRIPTION OF SERVICE

FocusHer is a mobile application designed to help users manage their daily routines, tasks, mood tracking, cycle tracking, hydration, and other wellness-related features. The App provides tools and features to assist with organization, productivity, and wellness management.

We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice.

3. USER ACCOUNTS

Account Creation

To use certain features of the App, you may be required to create an account. You agree to:

• • Provide accurate, current, and complete information when creating your account
• • Maintain and promptly update your account information
• • Maintain the security of your account credentials
• • Accept responsibility for all activities that occur under your account

Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.

4. SUBSCRIPTION AND PAYMENT

Premium Subscription

The App offers a premium subscription service that provides access to additional features. Subscription terms are as follows:

• • Subscriptions are billed on a recurring basis (monthly or annually)
• • Free trial periods may be offered, after which you will be charged automatically
• • You can cancel your subscription at any time through your device's subscription settings
• • Refunds are subject to the policies of the app store (Apple App Store or Google Play Store)

Payment Processing

Payments are processed through third-party payment processors (Apple App Store, Google Play Store). We do not store your payment information. All payment-related inquiries should be directed to the respective app store.

5. USER CONTENT AND DATA

You retain ownership of all data and content you create or upload to the App ("User Content"). By using the App, you grant us a license to:

• • Store and process your User Content to provide the App's services
• • Use anonymized and aggregated data for analytics and service improvement

You are solely responsible for your User Content. You agree not to upload, post, or transmit any content that is illegal, harmful, or violates any third-party rights.

6. INTELLECTUAL PROPERTY

The App, including its design, features, logos, and content, is protected by copyright, trademark, and other intellectual property laws. You may not:

7. PROHIBITED USES

8. DISCLAIMER OF WARRANTIES

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• • The App will meet your specific requirements
• • Any defects or errors will be corrected

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• • Personal injury or property damage

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• • Your use of the App
• • Your violation of these Terms
• • Your violation of any third-party rights

11. TERMINATION

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms. Upon termination:

• • Your right to use the App will cease immediately
• • We may delete your account and associated data

You may terminate your account at any time by deleting the App or contacting us at erenyilmaz.office@gmail.com.

12. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• • Posting the updated Terms in the App
• • Updating the "Last updated" date

Your continued use of the App after such changes constitutes acceptance of the modified Terms.

13. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Germany.

14. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
